TERMS AND CONDITIONS FOR VACATION PACKAGES
Effective Date: December 19, 2025
Please read these Terms and Conditions ("Agreement") carefully before booking any vacation package with [Company Name] ("Company," "we," "us," or "our"). By making a reservation or accepting any services provided by the Company, you ("Client," "Customer," or "Traveler") agree to be bound by the terms detailed below.
This Agreement governs the contractual relationship between the Company and the Client.
1. BOOKING AND RESERVATIONS
1.1 Acceptance of Booking:
A booking is considered confirmed only when the Company issues a written confirmation invoice. The Company reserves the absolute right to decline any booking request at its sole discretion without providing a reason.1.2 Information Accuracy:
The Client is solely responsible for ensuring that all names and details provided at the time of booking match the government-issued identification (e.g., passports) of all travelers exactly. Any costs associated with name changes or re-issuance of tickets due to incorrect information provided by the Client will be borne exclusively by the Client.1.3 Deposit Requirements:
A non-refundable deposit is required at the time of booking to secure your reservation. The specific amount of the deposit will be communicated during the booking process but generally ranges from 20% to 50% of the total package cost, depending on the destination and seasonality.2. PRICING AND PAYMENT POLICIES
2.1 Payment Schedule:
Full payment of the remaining balance is due no later than sixty (60) days prior to the departure date. For bookings made within sixty (60) days of departure, full payment is required immediately upon booking.2.2 Late Payments:
Failure to remit full payment by the specified due date constitutes a breach of contract. The Company reserves the right to treat the booking as cancelled by the Client and retain all deposits paid to date.2.3 Pricing Adjustments:
Prices are based on current exchange rates, tariffs, and taxes. The Company reserves the right to increase the package price in the event of fluctuations in currency exchange rates, fuel surcharges, or increases in government taxes or fees. If the price increase exceeds 10% of the original package price, the Client may cancel the booking within seven (7) days of notification for a full refund, excluding any non-refundable deposits or premiums paid.3. CANCELLATION AND REFUND POLICY
3.1 Customer Responsibility for Travel Insurance:
It is the sole responsibility of the customer to determine and purchase travel insurance in connection with any vacation package or service reserved through The Costa Rica Surf Company. The Company strongly recommends that all travelers obtain comprehensive travel insurance including, but not limited to, “Cancel for Any Reason” coverage as well as medical and health travel insurance. If the customer elects not to purchase travel insurance (including “Cancel for Any Reason” coverage), the customer does so entirely at their own risk, and The Costa Rica Surf Company shall not be held liable for any loss, cost, expense, or lack of refund related to that decision. Refunds for cancellations, trip interruptions, or emergencies cannot be guaranteed and, in scenarios where travel insurance has not been secured by the customer, will be dictated solely by the policies and discretion of our third-party vendors and suppliers. The Costa Rica Surf Company does not control the policies of hotels, tour operators, and other service providers and does not guarantee refunds or compensation for changes, cancellations, or missed services arising from circumstances outside its control.3.2 Pass-Through Vendor Policies:
In addition to these terms and conditions, all policies of our third-party vendors and suppliers—including, but not limited to, those governing cancellations and refunds—are passed through to the customer as a matter of contract. The customer is strongly encouraged to carefully review and understand the terms, conditions, cancellation, and refund policies of all vendors involved in their vacation package. The Costa Rica Surf Company will not be held responsible for the outcome of claims, disputes, or refund requests governed by these external policies.3.3 Refund Eligibility and Limitations:
For cancellation requests submitted in writing 30 days or more prior to the scheduled trip start date, a partial refund will be issued. The maximum refundable amount in these cases is 90% of the purchase price, with the remaining 10% withheld to cover non-recoverable vendor expenses, administrative work, and other costs already incurred by The Costa Rica Surf Company.
For cancellation requests within 30 days of the scheduled trip start date, refunds are not guaranteed and, in most cases, are not available. This policy reflects the non-refundable nature of many of the supplier relationships and high costs incurred close to the departure date. We again strongly encourage all customers to purchase comprehensive, “Cancel for Any Reason” travel insurance to protect their investment.
No refunds will be provided for “no-shows,” early departures, or unused portions of vacation packages, including but not limited to accommodations, transport, tours, or meals once the trip has started.
In all cases, the issuance, amount, and method of any refund are subject to the policies of our suppliers and vendors. Refunds will only be processed to the original form of payment.
3.4 Changes/Substitutions for Hotels and Tours:
While The Costa Rica Surf Company endeavors to provide the exact hotel and tour options listed at the time of booking, it is understood that circumstances outside of our control may result in changes to accommodation or tour availability. In such situations, The Costa Rica Surf Company reserves the sole and exclusive right to substitute a comparable hotel in a comparable location or a comparable tour option, without liability or further obligation.3.5 Additional Terms:
All refund requests must be made in writing and sent to The Costa Rica Surf Company’s official contact address.
Refunds will be processed within a reasonable timeframe after receipt and review of the cancellation and any required supporting documentation.
If a refund is approved and issued, the customer agrees that it represents full and final resolution of all claims relating to the planned services.
The above policy does not limit or waive any rights that may be required to be provided by law.
By proceeding with a booking, you acknowledge, accept, and agree to these terms regarding cancellations, refunds, travel insurance, and vendor conditions.- 61 days or more prior to departure: Forfeiture of non-refundable deposit.
60 to 46 days prior to departure: 50% of the total package cost.
45 to 31 days prior to departure: 75% of the total package cost.
30 days or fewer prior to departure: 100% of the total package cost (no refund).
3.2 No-Shows and Early Departures:
No refunds will be issued for "no-shows" or for any unused portion of the vacation package, including but not limited to accommodation, transport, sightseeing tours, or meals, once travel has commenced.3.3 Cancellation by Company:
The Company reserves the right to cancel any tour or vacation package for any reason. In such rare instances, the Company will offer a comparable alternative or a full refund of all monies paid. The Company is not responsible for any additional expenses incurred by the Client in preparation for the trip (e.g., non-refundable air tickets, visa fees, equipment, medical expenses).4. TRAVEL DOCUMENTS AND IDENTIFICATION
4.1 Responsibility:
It is the sole responsibility of the Client to obtain and possess all valid travel documents, including but not limited to passports, visas, vaccination certificates, and re-entry permits required for entry, departure, and travel through each country or region included in the itinerary.4.2 Validity:
Passports must be valid for at least six (6) months beyond the intended date of return. The Company accepts no liability if the Client is refused entry onto a flight or into any country due to failure to carry correct and valid documentation.5. TRAVEL INSURANCE REQUIREMENTS
5.1 Mandatory Coverage:
The Company strongly advises and, for certain packages, mandates that the Client purchase comprehensive travel insurance. This insurance should cover, at a minimum: trip cancellation, trip interruption, medical expenses, emergency evacuation and repatriation, and baggage loss/delay.5.2 Waiver of Liability:
By declining travel insurance or purchasing inadequate coverage, the Client assumes full financial responsibility for any and all costs associated with cancellations, medical emergencies, or other unforeseen events. The Company shall not be liable for any costs that would have been covered by a standard travel insurance policy.6. LIABILITY DISCLAIMER AND LIMITATIONS
6.1 Third-Party Suppliers:
The Company acts solely as an intermediary and agent for the suppliers identified on your itinerary, including airlines, hotels, bus companies, railroads, cruise lines, and other service providers ("Suppliers"). The Company does not own or operate these entities.6.2 Limitation of Liability:
The Company is not liable for any negligent or willful act or failure to act of any such Supplier or of any other third party. The Company assumes no responsibility for any injury, loss, death, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle, or through the act or default of any company or person engaged in conveying the passenger or in carrying out the arrangements of the tour.6.3 Assumption of Risk:
The Client acknowledges that travel involves inherent risks, including but not limited to political instability, acts of terrorism, civil unrest, natural disasters, health hazards, and accidents. The Client voluntarily assumes all risks associated with such travel and agrees to release the Company from all liability arising from such risks.7. FORCE MAJEURE
The Company shall not be liable for any failure or delay in the performance of its obligations under this Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation: acts of God, natural disasters (earthquakes, fires, floods, hurricanes), war, terrorism, civil commotion, riots, strikes, labor disputes, government acts or restrictions, pandemics, epidemics, or significant fluctuations in foreign exchange markets ("Force Majeure Event").
In the event of a Force Majeure Event, the Company may, at its sole discretion, vary the itinerary, delay the departure, or cancel the tour. Refunds or credits in such scenarios will be subject to the deduction of unrecoverable costs incurred by the Company.
8. HEALTH AND SPECIAL REQUIREMENTS
8.1 Health Certification:
By booking, the Client certifies that they do not have any mental, physical, or other condition or disability that would create a hazard for themselves or other travelers. The Company reserves the right to decline acceptance of anyone whom it considers unsuitable due to fitness level.8.2 Accessibility:
The Client must notify the Company at the time of booking of any physical or mental disability or other condition that requires special accommodation. While the Company will make reasonable efforts to accommodate such requests, it cannot guarantee that all services or facilities will be accessible.9. ITINERARY CHANGES
The Company strives to operate all tours as advertised. However, specific itineraries are subject to change without prior notice due to local circumstances or events. The Company reserves the right to alter the order of sightseeing, substitute hotels of a similar category, or change transport methods if necessary for the safety, comfort, or well-being of the travelers. Such changes do not constitute a material alteration of the package and do not entitle the Client to a refund.
Please Note: While we make every effort to provide the exact hotel and tour options listed in your itinerary, situations may arise—such as supplier issues, unforeseen events, or other circumstances beyond our control—that result in certain hotels or tours becoming unavailable. In such cases, The Costa Rica Surf Company reserves the right, at its sole discretion and without notice, to provide a comparable hotel in a comparable location or a comparable tour option. By booking, the Client acknowledges and accepts the possibility of such substitutions, and agrees that these substitutions do not constitute grounds for a refund or compensation.
Group Trips: When booking a group trip, please note that a minimum number of travelers is required for the inclusion of a vacation concierge. Additionally, the availability of a vacation concierge for group trips is subject to concierge scheduling for the specified dates and locations. While we endeavor to accommodate group trips as requested, in the event the minimum number of travelers is not met or a vacation concierge is not available, the customer’s booking will be converted to our standard vacation package, which does not include a vacation concierge. Group trips and the addition of a vacation concierge are therefore not guaranteed.
Liability Disclaimer: The Costa Rica Surf Company shall not be held liable for the actions or omissions of any selected vendor, other travelers, drivers, or for any incidents arising from weather events or other circumstances beyond our reasonable control.### 10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law principles.10.2 Arbitration:
Any dispute, controversy, or claim arising out of or relating to this Agreement, including the breach, termination, or invalidity thereof, shall be settled by binding arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (or equivalent local body) by a single arbitrator. The place of arbitration shall be the Company's headquarters. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.10.3 Class Action Waiver:
The Client agrees that any legal proceedings shall be conducted on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written. No modification or waiver of any provision of this Agreement shall be effective unless in writing and signed by an authorized representative of the Company.
BY PROCEEDING WITH A BOOKING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
